These Terms & Conditions govern your use of the Eminence Jewels Ltd (“Eminence Jewels”, “we”, “us”, “our”) website, your enquiries, orders, and purchases through www.eminencejewels.com (“Website”). By accessing this Website or placing an order, you agree to these Terms & Conditions.
These Terms & Conditions work together with our Privacy Policy, which you can view on our Website.
1. Definitions
-
“You” means the person using or accessing the Website and/or purchasing goods or services from us.
-
“Products” means jewellery and related services offered through the Website.
-
“Bespoke” means custom-made items designed and created specifically for you.
2. Eligibility & Use of Website
By using this Website, you confirm that you are at least 18 years old or accessing it with the consent of a parent or legal guardian.
You agree not to use the Website in any manner that interferes with its proper operation or security. You may print or download parts of the content provided this is solely for your personal, non-commercial use and does not infringe our intellectual property rights.
3. Intellectual Property
All designs, jewellery images, renders, text, graphics and content on this Website are the exclusive intellectual property of Eminence Jewels Ltd and are protected under UK copyright and design law.
Unauthorised copying, reproduction, or commercial use of any content, designs, or images without our written permission may result in legal action.
4. How to Order
Eminence Jewels specialises in bespoke, made-to-order jewellery. Orders are not placed via an online basket system — instead you begin your journey by completing our Bespoke Enquiry Form or contacting us directly, as outlined on our FAQs page.
Once a member of our team has discussed your requirements, we will provide a quote and design pathway before confirming any final order.
5. Pricing
Because each piece of jewellery is bespoke and tailored to your specifications — including diamond quality, metal choice, and design details — prices are not listed on the Website and will be provided during the consultation process.
We aim for accuracy in all quotes, but may correct clerical or pricing errors at our discretion before the order is confirmed.
6. Payment Terms
For all orders, full payment is required once the order has been agreed.
Payments must be made via bank transfer unless otherwise specified in writing.
Bespoke orders are non-refundable once production has begun, in line with your bespoke jewellery purchase process.
International Transfers
If you choose to pay via international bank transfer, you are responsible for all intermediary and originating bank charges. We do not charge a fee for receiving international transfers.
7. Delivery & Risk
We will arrange delivery of your jewellery once crafted. Responsibility for the jewellery passes to you once it has been delivered and signed for, or otherwise accepted by you or your nominated recipient.
For high-value items, a signature may be required. If delivery is attempted and no signature is obtained, or if the courier records attempted delivery, liability may shift in accordance with the courier’s terms.
If a shipment arrives damaged or tampered with, you must note “DAMAGED” clearly on the delivery agent’s paperwork. Failure to do so may invalidate any insurance and limit our ability to assist.
International deliveries may be subject to local duties or taxes imposed by customs in the destination country — these charges are your responsibility.
8. Refunds & Returns
As stated in our FAQs — and given the bespoke nature of our jewellery — we do not offer refunds or exchanges once payment is received.
If you believe your item is faulty upon delivery:
-
You must notify us in writing within 48 hours of delivery,
-
Provide clear photographs and your order details,
-
Our team will assess the issue and respond promptly.
This process is also detailed in our FAQs.
Earrings
Due to hygiene and safety, earrings cannot be returned, except where legally required due to a fault.
9. Ring Sizing
Ring size charts on our Website are provided for guidance only. Sizes may vary slightly and are accurate within approximately ¼ finger size. We cannot be held responsible for ring size discrepancies if guidance was relied upon inaccurately.
10. Diamonds & Ethical Sourcing
We source diamonds from reputable dealers who comply with the Kimberley Process and applicable ethical sourcing standards. Diamond weights may vary slightly within accepted industry tolerances.
11. Warranty & Service
While we do not offer a standard warranty, we provide cleaning and repair services, including:
-
Diamond and gemstone resetting,
-
Re-polishing,
-
Ring resizing.
Service times and costs are provided when you book your item in with us.
12. Limitation of Liability
Nothing in these Terms limits liability for:
-
Death or personal injury resulting from negligence,
-
Fraudulent misrepresentation,
-
Any liability that cannot legally be excluded.
Subject to this, we shall not be liable for indirect or consequential losses arising from your use of the Website or purchase of Products.
13. Cookies & Privacy
Our Website uses cookies in line with our Privacy Policy, which explains how we use cookies and your data.
14. Changes to Terms
We may update these Terms & Conditions from time to time. The most recent version will always be published on our Website. Continued use of the Website and purchase of Products signifies your acceptance of updated Terms.
15. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales. You and we agree that the English courts have exclusive jurisdiction over any dispute.
16. Severability
If any part of these Terms is found to be unenforceable under applicable law, it will be severed without affecting the remaining provisions.
